LIABILITY OF BOARD MEMBERS

1. The district, subject to appropriation, will indemnify Committee members for expenses in damages incurred in the defense or settlement of a claim.
2. The amount of indemnification is not to exceed one hundred thousand dollars for each member.
3. The claim must have arisen while such District School Committee member was acting within the scope of his/her official duties.
4. The defense or settlement of such claim shall have been made by an attorney legally employed for the purpose of the district or by an attorney employed by the insurer obligated under the terms of the policy of insurance to defend the district against such claim (General Laws, Chapter 41, Section 100E).
